Good morning.  It’s Wednesday, April 27, 2005, and this is your first early morning briefing.

The May sweep begins tomorrow (April 28-May 25). Before we jump headlong into the sweep, here’s how the most recent full week (4/18-4/24) for the broadcast networks shaped up:

A18-49:  Fox 3.7/11; CBS 3.7/10, ABC and NBC tied at 3.2/9, WB 1.4/4, UPN 1.3/4

Adding a little more fodder to your predictions for May – here’s how the networks are doing season to date – that is September 20 thru April 24, 2005:

Tonight’s Premieres:
Biography Channel:  What’s Next at 11p; Hollywood’s Best 10 at 1130p

Following ABC‘s announcement of its Primetime Live special Fallen Angel that promises to “explore explosive claims” from behind the scenes at American Idol, its being reported by Drudge that ABC has now received written notice from Fox that it may bring legal action against ABC if it determines ABC’s show is trying to “maliciously destroy” American Idol. The show is planned to air on ABC, May 4 at 10p.

* NEW ORDERS / DEVELOPMENT / PRODUCTION *

20th Century Fox has signed Josh Berman to a four year development deal, in the seven figure neighborhood, per Variety. Lest you think he may be jumping ship from CBS’ primetime megahit CSI, no worries – he’s contracted there as co-executive producer through the 2006-07 season. Aside from that, he’ll begin developing new series for Fox as of June 1 of this year.

Writer/producer Steven Maeda has signed a two-year deal with Touchstone Television, which will bring him on as co-exec prod of ABC’s Lost next season.  The deal also calls for Maeda to develop original projects for the studio.

Universal Pictures has signed a first look deal with Film 44, headed up by Peter Ber, John Cameron and Sarah Aubrey, per Hollywood Reporter.

* MORE GOOD STUFF *

Verizon Communications and Showtime have signed a deal to distribute on Verizon’s fiberoptic service called Verizon FiOS TV, set to launch later on this year.  Showtime will provide a content from 11 of its channels including Showtime, Showtime Showcase, Showtime Extreme, Showtime Family Zone, The Movie Channel, and Flix, as well as Showtime HD and TMC HD.  All together, Showtimes contribution adds up to 150 hours of movies and original series, and according to  Broacasting & Cable, 25% of that content will change weekly.  Previously signing up with Verison FiOS were NBC and its stable of networks, and Starz.

Bravo will launch a new series on August 10 called The Daily News (Hearst Ent), a six part documentary that highlights day-in-and-day-out operations at the New York Daily News.  Each episode with focus on a group of journalists as they move through their day, covering various stories around the city, and the paper’s notorious competition with the New York Post.  Debuting the same day is Battle of the Network Reality Stars, a six ep remake of the show of yore, but with reality show ‘stars.’ A few other dates to add to your premiere calendar for this summer:  June 1 – Sports Kids Moms & Dads; June 30 – Being Bobby Brown; July 27 – Kathy Griffin: My Life on the D-List; August 2 – Situation: Comedy; and August 18 – Hidden Howie: The Private Life of a Public Nuisance.

Martha Stewart Living Omnimedia, Inc. and Warner Home Video, Inc. have entered into an exclusive multi-year agreement to create and distribute a line of home video releases, theme-based on the 1,500-hour library of MSLO, including the upcoming syndicated series set to premier this fall. The collection is due out in fourth qtr of this year.  The distribution agreement covers the United States and Canada.

Today at 2pm the New York State Court of Appeals will hear Court TV‘s challenge to the state’s ban on cameras in the courtroom. The network will preempt regularly scheduled programming to carry the hearing live.  Court TV is arguing that a 1952 state law banning cameras in trial courts is unconstitutional under the guarantee of free speech and press embodied in both the First Amendment to the U.S. Constitution and in the N.Y. State Constitution.

A handful of premieres are coming up on The Biography Channel – the first two scheduled for this evening:

  • What’s Next is the network’s first in-house production, a weekly magazine looking at the most recent releases in film, video, music and TV with host Kelly Deadmon. Premieres tonight at 11p;
  • Hollywood’s 10 Best is a countdown series of many of Hollywood’s most favorite moments, be they cat fights, comic book movies, or best beauty-to-beast transformations. Tonight’s ep debuts at 1130p with Hollywood’s 10 Best Kisses; and
  • Dead Famous: Ghostly Encounters will debut in third qtr 2005 and follows real life ghostbusters as they go in search of the dearly departed – but not just any one, they’re looking for celebrities.

In conjunction with New Vision Sports Properties, CSTV Networks, Inc. has secured an exclusive multiyear multimedia and marketing rights partnership starting this fall featuring the Southwestern Athletic Conference (SWAC), Mid-Eastern Athletic Conference (MEAC) and Southern Intercollegiate Athletic Conference (SIAC), athletic conferences representing historically Black colleges and universities.  The agreement gives CSTV exclusive rights to televise regular season and championship football, men’s and women’s basketball and all other men’s and women’s sports from these conferences, and also includes all broadband, high-definition, Internet, video-on-demand, and terrestrial and satellite radio rights.  This marks an expansion of CSTV’s preexisting football agreement with SWAC, resulting in the creation of an annual Football Classic Series premiering on the network fall 2005.  CSTV’s Football Classic Series will showcase both the Saturday games as well as cultural and social aspects of the weekend events.  The initial CSTV Football Classic series schedule includes the following Saturday games (with others to be added): September 24-Atlanta Atlanta Football Classic, Florida A&M vs. Tennessee State (4p); October 1-Gulf Coast Classic, Alabama St. vs. Southern (4p); October 15-Big Easy Classic, Southern vs. Jackson State (8:30p); November 19-Capital City Classic, Jackson State vs. Alcorn State (time TBD).

DIY Network will launch its first national print campaign next month. The campaign was created and executed by Doner and looks to increase awareness of the digital network, and drive consumers to the net’s website to find whether they already have DIY and if not, how they can get it.

8 Guys Out has named Alan Gabay as its new COO, working with its two co-founders Jocelyn Fenyn and Robin Koocher in expanding national and international opportunities, as well as overseeing P&L Management, licensing and franchising for the company. He will be based in Miami.
 
MTV has upped Rachel Baumgarten to VP/Integrated Marketing. Other announcements included: Catherine Balsam-Schwaber has joined MTV Integrated Marketing in LA as Senior Director; Carryl Pierre has been named Director/MTV Business Development; and Sean Phillips has been named Director/Integrated Marketing for mtvU.  Rachel will head up the newly formed Client Services group, which will focus primarily on providing the Ad Sales team with vital support to maintain and grow existing client relationships.  Catherine will be working closely with MTV Original Series Development to oversee integrations as well as the Los Angeles Ad Sales team to strengthen relationships with West Coast based advertisers. As Carryl moves to Director/MTV Business Development group, she will work with the Ad Sales group’s New Business team to develop relationships with potential advertisers as well as identify/break into any untapped resources in the marketplace.  Sean Phillips as Director for mtvU will work to continue to grow the mtvU brand and bring it into the future. 

World Wrestling Entertainment has named Joan Aceste as SVP/Legal Affairs.  Joan will oversee the intellectual property group, providing legal and business affairs support for WWE’s 24/7 SVOD Service, merchandising, licensing, talent contracts, copyright and trademark issues, and rights and fair use issues.

Monday – A18-49 Analysis:  Out in front on Monday night was NBC with an overall 4.6/12 A18-49, according to fast affiliate ratings from Nielsen Media Research, though just by a single share point – CBS delivered a 4.1/11, followed by Fox 3.8/10, ABC 2.9/8, WB 1.8/5, UPN 1.2/3.  At 8p Fear Factor won the hour with a 3.9/11, ahead of Fox’s Nanny 911 spinoff Marriage 911 which delivered a 3.0/9.  At 9p a three-way tie between CBS, NBC and Fox, all pulling an 11 share for the hour.  At 10p, NBC pulled out in front again with Medium, averaging a 5.4/14, over CBS’ CSI Miami repeat (5.0/13).
