Google violated antitrust laws by maintaining a monopoly on online search and general text adverting, ruled a federal judge. The Justice Department and states had sued Google, accusing it of illegally paying billions of dollars to be the automatic search engine on smartphones and web browsers. “Google is a monopolist, and it has acted as one to maintain its monopoly,” said Judge Amit P. Mehta in his ruling.

The Global Alliance for Responsible Media has shut down following a lawsuit by X alleging the group conspired to boycott advertising on the platform. “GARM is a small, not-for-profit initiative, and recent allegations that unfortunately misconstrue its purpose and activities have caused a distraction and significantly drained its resources and finances,” said the group said in a statement on Friday. “GARM therefore is making the difficult decision to discontinue its activities.” Posted X CEO Linda Yaccarino, “No small group should be able to monopolize what gets monetized. This is an important acknowledgement and a necessary step in the right direction. I am hopeful that it means ecosystem-wide reform is coming.” GARM, founded in 2019 to help brands avoid having their advertisements appear with illegal or harmful content, had encouraged advertisers to avoid X after Elon Musk took over the company in 2022, concerned about racist content and misinformation. In its lawsuit, X asked for a jury trial, compensatory damages and injunctive relief. “We tried being nice for 2 years and got nothing but empty words,” posted Musk on X. “Now, it is war.”

TikTok and parent company ByteDance asked a US appeals court to reject the Justice Department’s bid for court approval “to file more than 15% of its brief and 30% of its evidence in secret,” as the Justice Department seeks to force the divestiture of TikTok’s US assets by January 19 or face a ban. If they “are unable to review the government’s evidence,” said ByteDance, TikTok “will be unable to rebut contentions that are factually incorrect – let alone explain to the court why the government’s arguments and evidence are legally insufficient.”

Meanwhile, TikTok has launched Spotlight, a solution enabling entertainment marketers to promote movies and series. TikTok Spotlight identifies applicable TikToks on the platform and attributes an anchor link. The link drives audiences to a dedicated landing page where they can find details like synopsis, cast, official accounts, and a collection of other creator content linked to the same title. From the landing page, users can watch on streaming platforms. “Gone are the days of huddling around a water cooler to talk about last night’s episode or weekend blockbuster,” said James Stafford, Global Head of Publishers, TikTok. “With TikTok Spotlight, we are harnessing the ‘water cooler effect’, offering a full-service marketing platform that is supercharging our organic ecosystem, driving community and business results for entertainment marketers.”

Dentsu announced a global integration of Quantcast with Merkury, its global data, identity, and insights platform, enabling clients to access more than 10,000 custom consumer data attributes to build audience profiles and apply scaled AI to identify relevant consumers based on millions of online data signals across CTV, desktop, and mobile devices. “Despite Google’s recent announcement, continued cookie deprecation across the industry and heightened privacy regulations globally have introduced a new set of challenges for the modern marketer,” said Gerry Bavaro, Chief Strategy Officer, Merkury at dentsu. “To help brands navigate this rapidly evolving world, we’ve focused on developing innovative, brand-first solutions that are globally scaled but locally relevant. Freeosk announced an integration with Place Exchange to offer advertisers access to in-store, experiential retail media inventory for the first time. Marketers can now seamlessly activate messaging on Freeosk’s discovery kiosks. Initial in-store inventory will be available at ShopRite through the same demand-side platforms advertisers already use. “The demand for in-store retail media activation is surging as marketers push for incremental growth opportunities,” said Ari Buchalter, CEO of Place Exchange. “Brands want highly motivating, immersive experiences to make lasting impressions that promote trial and build CLV (customer lifetime value). Department stores’ streaming ads were 19% more effective than the category’s Convergent TV average, according to EDO’s annual Department Store Convergent TV Outcomes Report. Findings include:
· Walmart was the winner in the space, with an ad engagement rate 144% more effective than the category average. Target’s linear ads outperformed its convergent TV average by 7.5%, while Marshalls’ streaming ads outperformed its convergent average by 43%.
· The highest propensity to engage with convergent TV ads for men is among those ages 18-24 (+22%), while the highest propensity to engage with ads for women is 55-64 (+72%).
· The lowest propensity for both men and women were viewers in the 35-44 age range (-20% for men; -23% for women).
· Tuesday, Wednesday, and Thursday marked the days with the most engagement, while Morning Daytime, Afternoon Daytime, and Early Fringe all proved more effective than Primetime.

MEASUREMENT

DatafuelX announced that M3, its full-service platform for transacting against all currencies, has seen 118 ordered Data Driven Linear (DDL) campaigns representing $71.9 million in campaign spend supported since it launched in June 2022. Overall, datafuelX says 56% of its revenue growth in DDL campaigns came from new clients, with the remaining 44% coming from existing clients. “M3 was developed in direct response to the industry embracing a shift toward a multi-measurement marketing place and to enable utilization of alternative currencies by buyers and sellers,” said Spencer Lambert, VP, Product & Partnership Success. “Its growth underscores the expanding interest in and use of DDL by sellers to realize better yield from their inventory and by buyers to better optimize their audience targeting.”
