Good Morning.  It’s Monday, March 17, 2008, and this is your first early morning briefing.

The ongoing feud between InterActiveCorp CEO Barry Diller and John Malone, controlling shareholder of Liberty Media, may have some resolution on March 28 as the Delaware Chancery Court Judge Stephen Lamb will rule if Diller violated his proxy agreement after both sides present briefs this Friday. The rift occurred last November when Diller wanted to spin off IAC’s HSN, Ticketmaster, LendingTree and the Interval time-share business into four separate businesses. Liberty, which has 30% equity in IAC, blocked the deal saying the split companies would dilute its 62% voting power. If the judge rules against Diller, he may be removed as Chairman/CEO. However, if the court decides he didn’t breach the proxy agreement, a second argument asking if Diller violated his duty to shareholders will be presented.

MOJO HD brings back a new season of I Bet You starting April 10 at 930p. During the second season with 14 new episodes, best pals and championship poker pros Phil “The Unabomber” Laak and Antonio “The Magician” Esfandiari will travel cross-country competing against each other and betting on almost everything they encounter. 

Wizard’s First Rule, the new first-run, live-action weekly series distributed by Disney-ABC Domestic Television has cleared in 84% of the U.S. including each of the top 50 markets. The scripted, one-hour series has been picked up by stations from broadcast groups such as Tribune Broadcasting Company, CBS Television Stations Group, Sinclair Broadcast Group, Hearst-Argyle Television, Clear Channel Broadcasting, Gannett Broadcasting, Hubbard Broadcasting, Post-Newsweek Stations, Scripps Howard Broadcasting, Belo Corporation, LIN Broadcasting, Weigel Broadcasting, Sunbelt Communications, Acme Television and Barrington Broadcasting. From executive producer Sam Raimi and based on Terry Goodkind’s novel Wizard’s First Rule and the fantasy series The Sword of Truth, the television series will be produced by ABC Studios, the studio’s first broadcast syndication project, with production on the 22 episodes set to begin this May.

WE tv’s debut of the documentary series High School Confidential on March 10 (10p) drew in 389,000 W18-49, 357,000 W25-54 and 208,000 W18-34 viewers.

Donny and Marie Osmond will co-host NBC’s live 2008 Miss USA Pageant from the Planet Hollywood Resort & Casino in Las Vegas on April 11 at 9p.

In a stunt which did boost ratings, actor/comedian Billy Crystal was on the roster for the New York Yankees for Thursday’s preseason telecast of the Yankees versus Pittsburgh Pirates game on the YES Network. The network posted its highest-rated and most-watched preseason game averaging a 1.1 HH rating and 89,000 viewers. Crystal, No. 60, was the Yankee’s designated hitter against Pirate’s pitcher Paul Maholm, and eventually struck out, and has been since bounced off the team.

Creative Television Marketing (CTM) launched a national television syndication ad sales service and its first client is representing Telco Productions’ syndicated barter inventory for the programs Animal Rescue, Dog Tales and Mission. All shows were formally represented by Tribune Entertainment.
Media General sold ABC affiliate WMBB/Panama City and KALB-NALB/Alexandria which is a dual NBC/CBS outlet to Hoak Media. Pending normal regulatory approval, the transaction is expected to close in second or third quarter. Terms of the deal were not disclosed. In a one-week period, Media General has now sold three of the five stations it had planned to sell that are located in mid-sized Southeast markets. The two remaining stations on the auction block are WCWJ/Jacksonville and WNEG/Toccoa, GA.

Clear Channel Communications finalized the sale of its television group, totaling 56 TV stations, to Newport Television, a holding company for Providence Equity Partners. The $1.1 billion transaction is approximately $200 million less than the terms of the original deal negotiated last April. For the last month, Clear Channel and Providence have been in court, as Clear Channel filed suit against Providence claiming it was delaying the closing. Providence also sued Wachovia for not providing financing for the deal. This new deal settles the outstanding litigation issues.

IMHO: While there is much on television I enjoy watching and am entertained by, there is only a handful of programs/specials/miniseries that can truly be considered great television – Roots, War and Remembrance, Shogun, Planet Earth and I know there are others you’ll add to your list.  Add also the newest miniseries seen on television – HBO Films and Playtone’s John Adams. One of the most compelling and riveting programs ever brought to television, and if we’re fortunate, HBO Films and Playtone will continue with others from the David McCullough series.  But that’s just my opinion.

~ PRODUCTION & DEVELOPMENT ~

FOX ordered the drama pilot Courtroom K created and written by Paul Attanasio, reports Variety. The one-hour project, about a judge, public defender and prosecutor in a Milwaukee courtroom, will have a dark feel similar to House as Paul also executive produces that series for FOX. On this new pilot, Paul executive produces with 20th Century Fox TV slated to produce.

CBS picked up the pilot project Mike Birbiglia’s Secret Public Journal, a 30m comedy that started as an NBC project in 2006. Andrew Secunda wrote and co-created the project with Mike Birbiglia, a stand-up comic who will star in the pilot. The action centers on Mike who lives with his girlfriend in Brooklyn and has to deal with the realities of adult life. CBS Paramount Network Television is producing the pilot.

Ken Davitian, who appeared in the 2006 movie Borat, has been cast in the comedy Starting Under on FOX, playing a guy named Ken. The comedy stars Bernie Mac who moves in with his son and starts working for him at a marketing firm. The project is produced by Warner Bros. TV and received a series commitment in early November.

The Smithsonian Channel has ordered up a new documentary series called The True Story from Blink Films, which looks into the real story behind iconic characters and films, reports THR. Subjects will include the real story of Indiana Jones, Eliot Ness, and the goings on at the house in Amityville.

CYNOPSIS DIGITAL – TODAY’S TOP STORY:   The United States is no longer the nation with the largest number of internet users. China overtook the US last month in users for the first time, according to the state-run China Internet Network Information Center. Researcher BDA China Ltd. estimates there are now over 220 million internet users in China, compared with 217.1 million in the U.S. Online ad revenue continues to lag in China, however, totaling $1.3 billion in 2007 compared to e-Marketer estimates of $21.4 billion in America.    Full edition: CYN DIGITAL. CYNOPSIS KIDS – TODAY’S TOP STORYUniversal Pictures and Dark Horse Entertainment, publisher of Dark Horse Comics, and producer of movies and TV series, have inked a three-year worldwide production and distribution deal establishing a studio home for Dark Horse’s properties.  Under the deal, Universal has access to all Dark Horse characters and properties, as well as material acquired by Dark Horse on its own and opts to develop as a feature film.  Meanwhile, Dark Horse has the option to independently produce its own material and to distribute movies through Universal.  Universal Pictures will open Hellboy II: The Golden Army, directed by Guillermo del Toro and based on Mike Mignola’s Dark Horse Comics character, on July 11, 2008.  Dark Horse Entertainment, which has produced a range of movies and TV shows, is represented by Endeavor and The Gotham Group. CYNOPSIS INTERNATIONAL – TODAY’S TOP STORYJapan’s Fuji Television Network Inc. has decided to turn itself into a holding company as of October 1, 2008 under the new, albeit tentative name of Fuji Media Holdings.  The move is reportedly to further develop the Fuji TV group’s management, business resources and more.  Under the new organization, Fuji TV, the TV broadcaster, will be spun off.  The change is also subject to approval with the company’s shareholders (next meeting is in June).  Full edition: CYN INTERNATIONAL

Thursday – A18-49 Analysis:  CBS gained a foothold to win Thursday night with 3.2/9 A18-49, according to final national ratings from Nielsen Media Research. At 8p, Survivor: Micronesia was the leader with 4.3/13. ABC’s Lost held its #1 position during 9p at 4.9/13. The field was tight at 10p as CBS’ Without a Trace encore and NBC’s Lipstick Jungle tied for first at 2.3/7 while ABC’s Eli Stone was right behind with 2.3/6.

FOX did win at 9p as the House rerun posted a 1.9/6. Then at 10p, NBC’s news magazine Dateline was first with 2.0/6, just a tenth of a rating point ahead of ABC’s 20/20 at 1.9.6.
